Palko is number 37 on the list of most cited US Supreme Court decisions. This ebook includes the full text of the Palko decision.

Frank Palko was charged with first degree murder in Connecticut. The jury found Palko guilty of second degree murder and the court sentenced Palko to life in prison. A state law allowed Connecticut to appeal the decision in a criminal case if there were errors during the trial. Connecticut appealed Palko's conviction and was granted a second trial. At the second trial, the jury found Palko guilty of first degree murder and the court sentenced him to death.

The Supreme Court ruled that the due process clause of the 14th Amendment does not incorporate the Fifth Amendment's Double Jeopardy Clause against the states. The double jeopardy to which Palko was subjected does not violate "fundamental principles of liberty and justice". Palko v. Connecticut 302 U.S. 319 (1937)

Palko was eventually overturned in Benton v. Maryland (1969).
